Trademark officials reject company bid

Australian trademark officials have made the decision to reject Victorian company WM Productions application to extend their trademark over a broader range of services including online material, videos, CDs and educational services.

 

The case gained notoriety when WM Productions sent a legal demand ordering produce Bill Leimbach (Lucky Country Productions) to cease using the words Waltzing Matilda as a title of his film, which was changed to Banjo and Matilda.

 

Blake Knowles of Cullens Patent and Trade Mart Attorneys represented Mr Liembach in that dispute said that “This decision by IP Australia is promising, and may act as a deterrent to others trying to register similar iconic Australian names,”
